Terms of Service

1. Acceptance

By creating an account or using DiffPay (“the Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

DiffPay is a pay tracking tool for healthcare shift workers. It calculates estimated earnings based on the shift data, differential rules, and overtime parameters you provide. The Service includes a free tier and a paid Pro subscription.

3. Calculations Are Informational Only

DiffPay is not a legal, financial, or tax advisory service. All calculations, including overtime estimates, blended rate computations, and paycheck comparisons, are provided for informational purposes only. While we strive for accuracy using FLSA-compliant formulas, we do not guarantee that calculations reflect your exact payroll outcomes. Employer pay practices, rounding, deductions, and local regulations may cause differences.

You should not rely solely on DiffPay output when filing wage claims, tax returns, or any legal action. Consult a qualified professional for advice specific to your situation.

4. Accounts

You are responsible for maintaining the security of your account. You must provide a valid email address. One person may not maintain more than one free account.

5. Subscriptions and Billing

Pro subscriptions are billed monthly or annually through Stripe. You may cancel at any time from the billing settings page. Upon cancellation, you retain Pro access until the end of the current billing period. No refunds are issued for partial periods.

6. Free Trial

New accounts receive 14 days of complimentary Pro access. No credit card is required. After the trial period, your account reverts to the free tier unless you subscribe.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. DiffPay does not collect or store any patient health information.

8. Limitation of Liability

To the maximum extent permitted by law, DiffPay and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to losses resulting from reliance on calculations, data loss, or service interruptions.

Our total liability for any claim arising from or related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim, or $50, whichever is greater.

9. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from the settings page. Upon deletion, all your data is permanently removed.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the email associated with your account. Continued use of the Service after changes constitutes acceptance of the updated Terms.
